Renting is becoming more and more common. So injuries at rental homes or apartments are becoming more so too. Maybe the landlord or apartment management company hasn’t addressed an issue in the home or at the apartment complex. What happens next? Your number one goal of course is so that they get fixed and so you don’t get injured. The most likely people to get injured are you and your family using the building. The second reason to have it in writing, is in case you DO get injured, you can enforce your legal rights as a tenant.
Your Landlord’s Obligations
Your landlord is obligated to keep the common areas safe and free of defects. And there are also even the actual interior premises. They’re obligated to keep things safe for you and your family . The building by variances and building codes, defects, all of this has to be kept at a safe standard. If you get a serious injury as a result of an accident that was caused by the building or a building condition or a maintenance condition that wasn’t taken care of — stairs and sidewalks, roofs and porches, these are all injuries we get calls from people about. You should find out what your rights are, take pictures, get witnesses, and go from there.
So renters you might feel intimidated or frustrated by the lack of action on behalf of your landlord, but you DO have rights. It’s always better to be safe than sorry of course.
